Terms and Conditions

1. Limited Warranty

Super Micro Computer, Inc. ("Supermicro") warrants that each Product (as defined below), if properly used and installed, will be free from defects in material and workmanship for a period of time from the date of Supermicro's invoice (the “Warranty Period”). The standard Warranty Period for Supermicro Products is set forth in the table below. "Product" is defined as a product developed and manufactured solely by Supermicro and does not include products, components, or software supplied by third parties. Software delivered with or as part of a Product is expressly provided “As Is” unless specifically provided for otherwise in an accompanying software license agreement. This Limited Warranty applies only to the original purchaser of the Product (“Customer”).

If a Product which is the subject of this Limited Warranty fails during the Warranty Period or does not conform to the published Product specifications and is returned in accordance with the Return Materials Authorization (“RMA”) process as detailed below, Supermicro will, at its option: 1) repair the Product, 2) replace the Product with another same or functionally equivalent Product, or 3) issue a credit to Customer for the then current value of the Product.

To receive the benefit of this Limited Warranty, (i) Customer must notify Supermicro in writing within the applicable Warranty Period that the Product is defective and must provide an explanation of the deficiency; (ii) Customer must follow Supermicro’s RMA process and instructions for return of the Product to Supermicro; and (iii) Supermicro must be satisfied that the claimed deficiencies exist and are not caused by any event that would void the warranty.

2. Warranty Void Conditions

This Limited Warranty does not cover any failure or defect caused by misuse, accident, abnormal or unusually heavy use, improper packaging or handling, neglect, abuse, alteration, improper installation, unauthorized repair or modification, improper testing, or causes external to the product such as, but not limited to, excessive heat or humidity, power failures, power surges, or acts of God. This Limited Warranty will be void if evidence is seen of screw holes created by Customer, burned-out chips, more than four broken wires, repair work performed or damage caused by a party other than Supermicro, or removal, alteration, or destruction of the original product identification markings.

3. Warranty Limitations

Except as specified in this Limited Warranty, Supermicro disclaims all other warranties, express or implied including, but not limited to any implied warranties of merchantability or fitness for a particular purpose. To the extent an implied warranty cannot be excluded, such warranty is limited in duration to the express warranty period. Some jurisdictions do not allow the exclusion of implied warranties or limitations on the duration of an implied warranty, so the above limitations may not apply.

Except as amended hereunder, Supermicro’s standard Terms and Conditions of Sale accompanying the Product shall apply to the Product.


Return Materials Authorization (“RMA”) Process

In the event that a Product needs to be returned to Supermicro for warranty service, Customer must first contact Supermicro to obtain a RMA number and instructions for return of the Product. Customer shall supply the following information to Supermicro to obtain an RMA number: invoice date, invoice number, product model name, serial number, and reason for return.

When returning a product for RMA, Customer must ship with freight prepaid in the original packaging. The RMA number must be clearly printed on the outside of the box in which the Product is returned. Supermicro will not accept any shipment without an RMA number or with an invalid RMA number. The RMA number will become invalid if the associated product is not received by Supermicro within 30 days from the date that the RMA number is issued to Customer. Service and/or handling charges may apply if Supermicro determines that (a) the Product was not defective, or (b) the Product warranty has been voided.

Customer should ensure its critical data is backed up to verified secondary sources. Supermicro shall not be liable for the loss of any Customer data.

Labor Warranty

Labor Warranty covers general technical support including general RMA requests, phone support, and one-way shipping and handling. Labor Warranty excludes the labor specifically associated with the repair or replacement of out of-warranty parts, for which additional service charges will apply.

Parts Warranty

Parts Warranty covers repair and replacement of parts in the Product and is subject to availability in Supermicro stock. If Supermicro does not have stock to replace the Product within 30 days, Supermicro may repair or replace with a functionally equivalent or refurbished Product or components.

Advance Cross-Ship

Subject to the terms and conditions set forth herein, Supermicro may cross-ship a replacement Product to Customer in advance before the defective Product is returned, provided that (i) Customer first contacts Supermicro to obtain a RMA number and instructions for return of the Product, and (ii) the defective Product is received by Supermicro within30 calendar days of the date that the replacement Product is shipped. Should Customer fail to return the defective Product within the aforementioned time period, Customer will be liable for the value of the replacement Product.

Return for Credit

Subject to the terms and conditions set forth herein, Products that do not conform to product specifications or are defective upon receipt may be eligible to be returned for credit, provided that (i) Customer first contacts Supermicro to obtain a RMA number and instructions for return of the Product within 30 calendars days of invoice date, (ii) the returned Product is received by Supermicro within 10 calendar days of the above eligibility period, and (iii) the returned Product is complete and in brand new condition. Supermicro will charge a restocking fee of no less than 15% of the original purchase price of the Product for any returned Product that is determined to be non-defective or arrives incomplete.

Out-of-Warranty Service

Supermicro may offer out-of-warranty services for Products outside the Warranty Period or if the Limited Warranty has been voided, upon Customer request. Additional shipping fees, service, parts, and other charges associated with any out-of-warranty services will apply.
